A Minsk Resident Gave His Father An Apartment And A Garage, But There Were Questions About The Transaction

It was eventually canceled.

A Minsk resident gave his father an apartment and a garage. The prosecutor's office assumed that this way the resident of the capital tried to avoid the enforcement of tax liabilities, and demanded to cancel the deal.

The former owner of the real estate owed Br80 thousand of income tax and penalties. The man gave the apartment and garage to his father when the issue of debt collection was already taken up by bailiffs. This fact led prosecutors to the idea that the generosity of Minsk resident has a selfish motive.

"During the inspection, the father of the debtor explained that he didn't use the garage and the apartment, while the expenses on the maintenance of real estate were borne by his son. The apartment and garage were given to him by the son allegedly in return for the return of the debt between close relatives, which the interviewee could not prove," said in the supervisory agency.

The Prosecutor's Office concluded that the gift agreements were concluded by the son and the father only for the sake of appearances. Thus, Minsk resident planned to avoid possible problems that could arise with the real estate due to the accumulated debt.

In the end, the court canceled the donation agreements. At the stage of consideration of the civil case the debtor paid the entire amount of income tax and penalties.
