Authorities are expanding the number of cases where they can take over foreign businesses.
Belarus has determined when the authorities will be able to take over the management of foreign investors' companies. The decree of the Council of Ministers was published on the National Legal-Internet Portal.
The document applies to relations arising from January 1, 2026 and is valid until December 31, 2028.
The law already has a provision, under which the state can temporarily manage companies, whose owners are citizens of so-called unfriendly countries (countries that imposed sanctions against Lukashenko's regime - Prim. Charter97.org).
Boblast executive committees and Minsk city executive committee should form registers of the relevant companies. Organizations will get there on the basis of the average number of employees and sales revenue. The analysis of the companies' activities should be carried out monthly.
The organization falls under external management if its management bodies or the owner actually ceased to participate in the activities of the organization. Or they intentionally take actions that may lead the company to the actual termination of its activities, liquidation or bankruptcy. The Belarusian authorities may interpret the last paragraph at their discretion, which may cause concern among foreign investors.
