The REP union has helped a fitness coach to resign in the right way.

Andrei Papraukin, head of the Navabelitski district court of Homel, decided to charge Br1,400 from the Promise of Life LLC in favor of the fired fitness trainer Alena Mikhailava, who had not been paid when she was fired, Homel Viasna writes.

The interests of the plaintiff were represented in the court of first instance by Leanid Sudalenka, the legal inspector of labour in Homel region.

The director of Promise of Life paid the salary to fitness trainers, as they say, in envelopes. As it turned out in court, sometimes the workers did not even sign up for receiving cash. This is what happened in the case of fitness trainer Alena Mikhailava. According to her, when she was fired, her employer did not pay her off, while the director was insisting on the opposite at the trial, saying that he had given her the money, but she had not signed up for it.

In the course of four court hearings, almost all the employees of the fitness club were interviewed as witnesses. The court took the side of the dismissed employee, collecting 1400 rubles in her favor.

The trade union lawyer declares that he is satisfied with the court verdict. The businessman now has to pay 1400 rubles for the unpaid 205 rubles.

"The labor legislation clearly regulates the responsibility of employers for the delay in the final payment when dismissing a person - if the employer delays the payment by one day, he has to pay the average for it. The court policy in this matter is to protect the employees. "On the day of dismissal, the employer is obliged to give not only the entire salary, but the final payment, which also includes the compensation of unused days of the employee's vacation," - the lawyer said.

And although the court decision has not yet entered into force, the labor inspector is confident that it will remain unchanged even if the businessman files an appeal.
