The Polish Ministry of Interior and Administration excluded the clause banning his stay on the territory of Poland, noted by journalist Wadim Sechowicz.

In this case, the national act came into conflict with the supranational legislation of the European Union: Alexander Moshenski, as it turned out, has citizenship of Cyprus. For this reason, as the Polish ministry's amendment states, his inclusion in "the list of foreigners whose stay on Polish territory is undesirable and their transfer to the Schengen information system for the purposes of refusal of entry and stay is impossible."

At the same time, other, bans adopted in July of this year continue to apply to the owner of the Santa Bremore company. In particular, they include the freezing of funds and economic resources in Poland, a ban on their provision, enhanced monitoring of possible attempts to circumvent these restrictions and exclusion from public procurement and tendering procedures.

Moshenski owns large fish processing and dairy plants in Belarus. He is called an oligarch loyal to Lukashenko and the dictator's "purse". However, he has avoided European sanctions since 2020, despite being placed on draft sanctions lists several times.

In 2022, he was also excluded from the EU's sixth package of sanctions thanks to Hungary's lobbying. This may be due to the fact that his closest associate, Sergei Nedbaylov, is Hungary's honorary consul in Brest.
